Thank you for choosing to book 5 Church Street. When you make this booking and we have confirmed this in writing (by email), you are entering an agreement with us. This is a contract made in England and is governed in all respects by English Law. Please read our terms and conditions of booking below.

1. Agent:

If you made your booking through an agent or third party, you are to note that the booking agent cannot be held liable for any costs or losses that may arise for any reason relating to 5 Church Street – any such issues must be taken up with owners of the cottage.

2. Prices:

The prices quoted on our website and those of our booking agents relate to all contracts made up to 31 December (of the year to which the prices relate). Any holiday bookings made for periods after this time are subject to price change.

The price of the accommodation includes the following:

Electricity, Linen, Cleaning prior to your arrival, Hot water, Central heating
The double bed and the two single beds will be made up for you with clean duvet covers, bottom sheet and pillowcases and towels (including kitchen tea towels) will be provided. This will be done on a change of letting only. A spare set of linen will be left for bookings of two weeks and over.

3. No smoking and no pets:

Pets are not permitted, except assistance dogs (by prior arrangement, so we can prepare for their comfort). The property is strictly No Smoking and we do not have a smoking area outside the cottage.

4. Cancellation and Insurance:

When you make your booking and we have received the required deposit to secure the booking, a legally binding contract exists between us that is non-cancellable and non-refundable, except in exceptional circumstances. You may still remain liable to pay in full or in part for the booking, even if you are unable to take your holiday. Even where you have not paid in full at the time of cancellation, you will remain liable for the full cost.
If for some reason you do need to cancel, it is important that you tell us at the first opportunity so that we may attempt to re-let the cottage and minimise your loss. We strongly recommend that you take out cancellation insurance to protect yourself against possible loss.

5. Booking Alterations:

It may be possible to alter any of your holiday arrangements after your booking has been confirmed. If you need to change your holiday dates, please let us know and we will do our best to help. The names of guests on the booking form must be the only persons staying during the rental period. Any changes should be notified to us by email prior to the rental period. We do not allow sub-letting of the property.

6. Minors:

Booking from persons under the age of eighteen years cannot be accepted.

7. Number of Persons:

The maximum number of persons allowed in 5 Church Street is four (one of whom may be a baby, sleeping in the hirers’ own cot). Additional persons may not be accommodated

8. Non-availability of Accommodation:

We would only cancel your holiday if your accommodation became unavailable for reasons beyond our control. We would attempt to offer you alternative accommodation, however if this was not possible, or unacceptable to you, then we would refund all monies paid by your for the holiday. Our liability would not extend beyond this refund.

9. Modifications and Descriptions:

Every effort has been made to ensure that the description of 5 Church Street and any other descriptions (including those of surrounding areas etc) contained on our website and those of our booking agents, Visit Buxton etc. are correct. We reserve the right to make modifications to the cottage specifications that are considered necessary in the light of operating requirements. In the interests of continued improvement, we reserve the right to alter or delete furniture, fittings, amenities or facilities, either advertised or previously available, without prior notice. If material changes occur after your booking is confirmed we will endeavour to advise you.

10. Arrival:

Your accommodation will be available to you from 3.30pm on the day of arrival, unless otherwise arranged. Please try not to arrive earlier –we will still be busy preparing your accommodation, and won’t be able to give you access into the cottage.

11. Departure:

Please be ready to leave the accommodation by 10.30am on the day of departure, unless otherwise arranged, as our housekeeper will be ready to undertake a changeover for our next guests. Please try to leave the accommodation as clean as possible, noting the requests stated in the Information and Advice book inside the property. (We request that you remove all refuse from the building, and strip the beds if possible.)

12. Damages and Breakages:

Please take care with our property. You are responsible and liable for any breakages or damages which you cause to the accommodation or its contents, other than “wear and tear”. Please report these as soon as they occur. We do not normally charge for minor breakages, but we may send you an invoice for repair or making good if the damage or breakage is significant, and we may make an additional charge of £50 if you did not report this.

We may also invoice you for the costs of excessive cleaning and tidying costs where the cottage has NOT been left in as “close as reasonably possible” condition as found, or if someone has been smoking in the property.

13. Liability:

We do not accept any liability for any damage, loss or injury to any member of your party or any vehicle, cycles or possessions, unless proven to be caused by a negligent act by ourselves or our employees or contractors whilst acting in the course of employment.

14. Equipment Failure:

We regularly check, maintain and replace all equipment in the cottage but occasionally items may fail unexpectedly. Where this equipment (e.g. washing machine, boiler etc) cannot be easily fixed (fuse etc) then we have left our contact details in the cottage and we will endeavour to sort out any problems as quickly as reasonably possible. The hirer accepts that they may have to accept alternative arrangements.

15. Disputes:

If you are not entirely satisfied with the accommodation you should contact us (as detailed in the cottage information and advice book) immediately to resolve the problem. If, after that, you still feel that the problem has not been resolved to your satisfaction then you must, within seven days of returning from your holiday, put your comments in writing to us. Unless this procedure is strictly observed we cannot entertain any claim arising out of the complaint.

16. Car Parking:

We have a parking space at the side of the property and a lockable cycle store to the rear. We do not accept any liability for loss of, or damage to, personal effects, baggage, motor car, motor-car accessories, cycles or any other item belonging to you or in your possession or on hire to you.

17. Wi-Fi and Internet:

As a guest at these premises using the broadband facilities, you agree that you will not use the Wi-Fi and Internet service for unlawful or illegal purposes.

18. Data:

Any data collected during the course of this booking may be kept on our computer. We will not pass on your contact details to any third party but we may use them to contact you in future in connection with your stay, or to promote the cottage. (Please see also our Privacy Policy)

19. Payment details

For all bookings we require a deposit of £50 to confirm the booking. We will charge this to your credit card or you must make sure that this reaches us within 5 days of making the booking. We will send you an email or letter confirming the booking and letting you know what the outstanding balance is. The balance must then be paid at least 30 days before the start of the holiday. For holidays which are to take place within 30 days of making the booking, the full balance is due on booking.

20. Refund policy

Any overpayment (by our error, or yours) will be refunded to the same payment card as soon as possible after the error comes to light. Deposits are non-refundable. The full balance payment becomes non-refundable 30 days before the commencement of your stay. We undertake to attempt to re-sell under these circumstances but any refund amount will be at our discretion.
